Attorney William Weiland, of Elkhorn, touched the breast of a 14 year-old girl in July 1995, while the girl was under Weiland's care. Weiland's contact with the girl was terminated immediately upon the girl's objection.

In September 1995, Weiland plead guilty to fourth degree sexual assault and child neglect, both Class A misdemeanors. Weiland was sentenced to six months in jail and three years probation, subject to conditions.

The Board concluded that, by committing fourth degree sexual assault and contributing to the neglect of a child, both Class A misdemeanors, Weiland committed a criminal act which reflects adversely on his honesty, trustworthiness or fitness as a lawyer in other respects, in violation of SCR 20:8.4(b).

In determining the appropriate level of discipline, the Board considered the fact that Weiland has no prior discipline, his conduct was unrelated to his practice of law, and Weiland has been punished for his misconduct through the criminal justice system.
