Disciplinary Proceedings Against Arthur

This court reviews the report of the referee recommending the dismissal of the Office of Lawyer Regulation (OLR) disciplinary complaint filed against Ronald A. Arthur alleging misconduct consisting of the commission of a criminal act that reflects adversely on his honesty, trustworthiness or fitness as a lawyer, contrary to SCR 20:8.4(b). No appeal has been filed.
The referee recommended dismissal was appropriate given that the complaint arose out of the same matters litigated in the previous disciplinary proceeding against Mr. Arthur resulting in the revocation of his license to practice law in Wisconsin. See In re Disciplinary Proceedings Against Arthur, 2005 WI 40, 279 Wis. 2d 583, 694 N.W.2d 910.
This court approves the referee’s findings of fact and conclusions of law, and adopts them. Claim preclusion may be applied to preclude litigation of issues that were previously resolved in court. See In re Disciplinary Proceedings Against Widule, 2003 WI 34, n.7, 261 Wis. 2d 45, 660 N.W.2d 686. We accept the referee’s recommendation to dismiss the complaint.
